USW v Nutrien – Preliminary Ruling
This preliminary ruling determines that the parties’ dispute concerning the interpretation of Article 6.04 of the Collective Agreement will be heard virtually. In reaching that conclusion, I found that the issue is a discrete procedural matter involving primarily contractual interpretation and limited evidence, making a virtual hearing fair, proportionate and efficient. Rather than convene a separate case management conference, I directed the Union to provide the Employer with reasonable particulars and production within specified timelines so that the preliminary hearing may proceed on a complete and orderly record.
