You cannot shorten a resignation date without cause.
In Compton v. Partners in Motion Pictures Inc. et al, the Saskatchewan Court of Queen’s Bench faced a situation where an employee resigned. After that, his employer shortened the effective date of his resignation without his consent. The employee sued. The Court held that “the actions of [the employer] in response to the notice of resignation, show that it did not accept the notice from the plaintiff. Rather, [the employer] sought to terminate his employment at an earlier date, without agreement, which change constituted constructive dismissal from his employment.”
